Terms of Service

1. Acceptance of Terms
By accessing, browsing, or using the Veblyn website, dashboard, API, or any related service (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
If you do not agree to these Terms, you must not access or use the Service. Your continued use of the Service following any modifications to these Terms constitutes your acceptance of those modifications.
2. Description of Service
Veblyn is a prediction market data platform that provides normalized, structured data from prediction markets and real-world signal sources through a web dashboard and RESTful API. The Service aggregates, normalizes, and delivers data from third-party sources including but not limited to Polymarket, Kalshi, PortWatch, OpenMeteo, and FRED (Federal Reserve Economic Data).
The Service includes: (a) a web-based dashboard for browsing and exploring prediction market data; (b) a REST API for programmatic access to normalized market data and real-world signals; (c) WebSocket connections for real-time data streaming (available on select plans); and (d) Parquet file exports for bulk data consumption (available on select plans).
Veblyn does not operate a prediction market, facilitate trading, or provide financial advisory services. The data delivered through the Service is aggregated from third-party sources and is provided strictly for informational purposes.
3. Account Registration
To access certain features of the Service, you must create an account. Registration requires a valid email address. We use email-based one-time password (OTP) authentication - there are no persistent passwords stored on our systems. Each time you log in, a unique code is sent to your registered email address.
Upon registration, you may generate one or more API keys to access the Veblyn API. You are solely responsible for: (a) maintaining the confidentiality of your API keys; (b) all activities that occur under your account or through your API keys; and (c) immediately notifying Veblyn at contact@veblyn.com if you suspect unauthorized use of your account or API keys.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You may not create multiple accounts to circumvent rate limits or other restrictions. Veblyn reserves the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans and Billing
Veblyn offers the following subscription tiers:
- Free - Dashboard access only. No API access. No cost.
- Pro ($299/month) - Full API access with up to 5,000 API calls per day. REST API only.
- Fund ($999/month) - Full API access with up to 50,000 API calls per day, WebSocket streaming, and Parquet file exports.
All paid subscriptions are billed monthly in advance through Stripe, our third-party payment processor. By subscribing to a paid plan, you authorize Veblyn and Stripe to charge your designated payment method on a recurring monthly basis.
You may cancel your subscription at any time through your account dashboard or by contacting us at contact@veblyn.com. Upon cancellation, your access to paid features continues until the end of the current billing cycle. No refunds are provided for partial months, unused API calls, or the remaining portion of a billing period after cancellation.
Veblyn reserves the right to modify subscription pricing with at least 30 days written notice. Price changes take effect at the start of the next billing cycle following the notice period. If you do not agree with a price change, you may cancel your subscription before the new pricing takes effect.
Failed payments may result in suspension of API access. If payment cannot be collected after multiple attempts, your account may be downgraded to the Free tier.
5. API Usage and Rate Limits
Each subscription tier includes specific daily API call limits as described in Section 4. API call counts reset daily at midnight UTC. Calls that exceed your daily limit will receive an HTTP 429 (Too Many Requests) response.
In addition to daily limits, Veblyn enforces per-second and per-minute rate limits to ensure fair use and platform stability. If you consistently approach or exceed your rate limits, we may contact you to discuss upgrading to a higher-tier plan.
Veblyn employs automated abuse detection systems. Patterns that may trigger throttling or suspension include: (a) sustained requests at or near the maximum rate for extended periods; (b) requests designed to circumvent rate limiting (such as rotating API keys or using multiple accounts); (c) requests that place disproportionate load on the system relative to legitimate use; and (d) any pattern that degrades the Service for other users.
Veblyn reserves the right to modify rate limits at any time. We will provide reasonable notice for changes that materially reduce your existing allocation.
6. Data Use and Redistribution
Your rights to use data obtained through the Service depend on your subscription tier:
- Free tier: Data accessed through the dashboard is for personal, non-commercial use only. You may not systematically copy, download, or redistribute dashboard data.
- Pro tier: You may use API data for internal business purposes, research, and analysis. You may not redistribute raw or minimally processed API data to third parties, publish bulk datasets derived from the API, or use the data to build a competing service.
- Fund tier: You may redistribute data obtained through the API, provided that: (a) you include clear attribution to Veblyn as the data source; (b) you do not use the data to create a service that directly competes with Veblyn; and (c) redistribution is consistent with the terms of the underlying data sources (Polymarket, Kalshi, etc.).
Regardless of tier, you may not: (a) scrape, crawl, or otherwise extract data from the Veblyn website or dashboard by automated means outside of the provided API; (b) use data from the Service to build or operate a prediction market data aggregation service that competes with Veblyn; or (c) sublicense or sell access to the Veblyn API itself.
7. Intellectual Property
Veblyn and its licensors retain all right, title, and interest in and to the Service, including the platform, website, dashboard, API design, normalized data schemas, derived signals, documentation, and all related intellectual property. These Terms do not grant you any ownership interest in the Service.
Raw prediction market data sourced from Polymarket, Kalshi, and other third-party platforms remains the property of those respective platforms and is subject to their terms of use. Veblyn's value-add - including data normalization, enrichment, cross-source correlation, derived signals, and structured schemas - constitutes Veblyn intellectual property.
You retain ownership of any original content, analysis, or derived works you create using data obtained through the Service, subject to the redistribution restrictions in Section 6.
The Veblyn name, logo, and branding are trademarks of Veblyn. You may not use these marks without prior written consent, except as required for attribution under Fund tier redistribution rights.
8. Data Accuracy and Disclaimers
THE DATA PROVIDED THROUGH THE SERVICE IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL ADVICE, INVESTMENT ADVICE, TRADING ADVICE, OR ANY OTHER KIND OF PROFESSIONAL ADVICE.
Veblyn aggregates data from third-party sources and makes reasonable efforts to ensure accuracy, but does not guarantee the accuracy, completeness, timeliness, reliability, or availability of any data delivered through the Service. Data may contain errors, omissions, or delays introduced by upstream sources, network conditions, or processing pipelines.
Prediction markets are inherently speculative. Market prices reflect the collective opinions of participants and are not guarantees of future outcomes. You acknowledge that: (a) prediction market data can change rapidly and without warning; (b) historical data does not predict future results; (c) any trading or investment decisions you make based on data from the Service are made at your own risk and discretion; and (d) you should consult qualified financial professionals before making investment decisions.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA.
9. Prohibited Conduct
You agree not to engage in any of the following activities:
- Using the Service or data obtained from the Service to manipulate or attempt to manipulate any prediction market, financial market, or other market
- Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or data infrastructure of the Service
- Launching or facilitating denial-of-service (DDoS) attacks or any other action intended to disrupt, degrade, or overload the Service
- Sharing, selling, or transferring your API keys to any third party
- Creating multiple accounts to circumvent rate limits, subscription restrictions, or abuse detection systems
- Using automated tools, bots, or scripts to access the dashboard in ways not authorized by the API
- Scraping, crawling, or systematically downloading data from the website or dashboard outside of authorized API usage
- Using the Service for any purpose that violates applicable local, state, national, or international law or regulation
- Transmitting viruses, malware, or any other malicious code through the Service
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity
- Interfering with the security, integrity, or performance of the Service or its underlying infrastructure
- Using the Service to collect personal information about other users without their consent
Violation of any of these prohibitions may result in immediate suspension or termination of your account, with or without notice.
10. Third-Party Services
The Service relies on third-party providers to deliver certain functionality. These providers include but are not limited to:
- Stripe - Payment processing. Your payment information is collected and processed by Stripe in accordance with Stripe's Privacy Policy and Terms of Service.
- Resend - Transactional email delivery (OTP codes, billing notifications, account alerts).
- MongoDB Atlas - Database hosting and data storage.
- Vercel - Website and application hosting.
Each third-party provider operates under its own terms of service and privacy policy. Veblyn is not responsible for the practices of these providers. By using the Service, you acknowledge and agree that your data may be processed by these third parties as necessary to deliver the Service.
The Service also incorporates data from third-party prediction markets and data providers (Polymarket, Kalshi, PortWatch, OpenMeteo, FRED). Your use of data originating from these sources may be subject to their respective terms.
11. Indemnification
You agree to indemnify, defend, and hold harmless Veblyn, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your redistribution of data obtained through the Service; or (e) any trading, investment, or other decisions made based on data obtained through the Service.
This indemnification obligation survives the termination of your account and these Terms.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VEBLYN, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, WHETHER ARISING FROM CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF VEBLYN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, VEBLYN'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO VEBLYN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF YOU ARE ON THE FREE TIER AND HAVE PAID NOTHING, VEBLYN'S MAXIMUM LIABILITY SHALL BE ONE HUNDRED DOLLARS ($100).
You acknowledge that the fees charged by Veblyn reflect the allocation of risk set forth in these Terms and that Veblyn would not enter into these Terms without the limitations on liability contained herein.
13. Service Availability
Veblyn strives to maintain high availability of the Service but provides it on a "best effort" basis. We do not guarantee any specific uptime percentage or service level agreement (SLA) unless separately agreed in writing.
The Service may be temporarily unavailable due to: (a) scheduled maintenance, for which we will make reasonable efforts to provide advance notice; (b) unscheduled maintenance required to address urgent security or stability issues; (c) outages at third-party providers (Vercel, MongoDB Atlas, upstream data sources); or (d) circumstances beyond our reasonable control, including natural disasters, network failures, or government actions.
Veblyn is not liable for any loss or damage resulting from service interruptions, data delays, or temporary unavailability of the platform or API. You are responsible for implementing appropriate error handling, caching, and fallback mechanisms in your systems.
14. Termination
Termination by you: You may terminate your account at any time by contacting us at contact@veblyn.com or through your account settings. If you have an active paid subscription, cancellation takes effect at the end of the current billing period.
Termination by Veblyn: We may suspend or terminate your account immediately, with or without notice, if: (a) you breach any provision of these Terms; (b) you engage in conduct that is harmful to other users, the Service, or Veblyn; (c) your account has been inactive for more than 12 months; or (d) we are required to do so by law.
Effect of termination: Upon termination: (a) all API keys associated with your account are immediately revoked; (b) your access to the dashboard and API ceases; (c) any outstanding payment obligations remain due; and (d) we will delete your account data within 30 days, except as required for legal compliance or as described in our Privacy Policy.
Sections 6, 7, 8, 11, 12, 15, 17, and 18 survive termination of these Terms.
15. Dispute Resolution
Governing law: These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Binding arbitration:Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware, or remotely at the mutual agreement of the parties. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver: YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive any right to participate in a class action lawsuit or class-wide arbitration against Veblyn.
Exception: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.
16. Changes to Terms
Veblyn reserves the right to modify these Terms at any time. For material changes, we will provide at least 30 days notice by: (a) sending an email to the address associated with your account; or (b) posting a prominent notice on the Veblyn website. Non-material changes (such as typographical corrections or formatting updates) may be made without notice.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and terminate your account before the changes take effect.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.
18. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Veblyn regarding your use of the Service. These Terms supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and Veblyn relating to the Service.
No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Veblyn's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
